Homeowners may Speak on Each Board
Motion
In the 2011, Arizona Revised Statute
A.R.S. 33-1804 was amended to allow homeowners to speak on each
individual Board Motion.
The following summary of the
changes was provided by Golden Vista's attorney, Carpenter,
Hazelwood, Degado & Wood, PLC:
OPEN BOARD OF DIRECTORS MEETINGS
A.R.S. §33-1248 (A),ID)
(condominiums) and §33-1804 (A),ID) (planned communities) impose the
following requirements at any Board or regularly scheduled committee
meeting:
1. Association members "or any person
designated by a member in writing as the member's representative"
must be allowed to attend and speak
"at an appropriate time during the
deliberations and proceedings." The Board must also permit the
member or designated representative to speak
"once after the board has discussed a specific
agenda item but before the board takes formal action on that item."
2. Reasonable time
limitations may be placed on persons speaking during the meeting,
but must allow a "reasonable number of persons to speak on each side
of an issue."
3.The agenda shall be available to all
members attending (Board meetings).
