The purpose of the Golden Vista RV Resort Association is to protect,
enhance and maintain the value of the properties. How do we
protect, enhance and maintain property values? Golden Vista RV
Resort is a deed-restricted community. That means that property owners
are subject to certain restrictions regarding the use and maintenance of
their property. All purchasers agree by signature to abide by these restrictions when
they purchase their lots in Golden Vista RV Resort. (See
Arizona Statute 33-1806 A.3 (h) which states: A statement
that provides "I hereby acknowledge that the declaration, bylaws and
rules of the association constitute a contract between the association
and me (the purchaser). By signing this statement, I acknowledge that
I have read and understand the association's contract with me (the
purchaser). I also understand that as a matter of Arizona law, if I
fail to pay my association assessments, the association may foreclose on
my property." The statement shall also include a signature line for the
purchaser and shall be returned to the association within fourteen
calendar days.)
The homeowner restrictions and the rules for the
operation of the Resort are contained in the governing documents.
These governing documents give the Board of Directors authority and
direction to govern the association. They consist of:

Articles of Incorporation - The articles of incorporation
are the formal documents filed with the State of Arizona (see:
Arizona Corporation Commission) that create
the association as a nonprofit corporation under the laws of the State
of Arizona. Amendments to these articles requires the affirmative vote
of at least 60% of a quorum vote (at least 638 Association Members
need to vote) cast by the Association Members.
- Declaration of
Covenants, Conditions & Restrictions (CC&Rs)
- The CC&Rs define how the physical entities that comprise the
association are to be used, that is, use restrictions, easements and
annexation.
The CC&Rs are
recorded in the official records of Pinal County, Arizona.
Amendments to the
CC&Rs requires the affirmative vote of
a quorum vote (at least 638
Association Members need to vote) cast by the Association Members.
- By-Laws - The By-Laws outline how the
association is governed and deals with the association as a
corporation, i.e. elections, assessment collections, terms of office
and duties of officers.
The By-Laws may be amended by the Board of Directors. The
By-Laws were amended and restated on December 1, 2009 and then placed
into a book entitled "Governing Documents for Golden Vista RV
Resort" that also included items 1&2 and 4&5. Since this
book was published, no amendments have been approved by the
Board.
- Rules & Regulations - The Rules &
Regulations combines those provided with the By-Laws
with those adopted by the Board of Directors within the guidelines of
the CC&Rs. The Rules & Regulations may be amended by the
Board of Directors. The Rules & Regulations were amended and
restated on December 1, 2009
and placed in the "Governing Documents
for Golden Vista RV Resort" book. Since this book was
published, no amendments have been
approved by the Board.

Design Guidelines - The Design Guidelines are a model for lot
improvement. They are reasonably flexible and are intended to provide opportunities for
creative, high quality development. It is the responsibility of the
owner to
comply with these Design Guidelines, as well as current local, state
and
federal building codes. The Design Guidelines may be amended by the Board
of Directors. were amended and restated on February 2,
2010 and placed in the "Governing Documents
for Golden Vista RV Resort" book. Since
this book was published, no amendments have been approved by the
Board.
- Resolutions - Formally deal with specific issues that require
detailed procedures to accomplish, like the collection of money and
architectural control.

- Arizona Statutes - Arizona State legislation takes precedence over all
other legal documents. Arizona statutes regarding associations
are in Title 33 - Property, Chapter 16 - Planned Communities.
Chapter 16 currently has 14 sections numbered 33-1801 to 33-1814.
